Magic Smoke, LLC ("we," "us," or "our"), operating as Magic Smoke Studio, provides the Art Magic mobile application ("the App"). Art Magic lets parents photograph artwork and watch it come to life as animated videos using artificial intelligence.

This privacy policy explains what data the App collects, how we use it, who we share it with, and your rights. It applies to all users of the Art Magic mobile application on iOS and Android.

1. Information We Collect

Account Information

• Email address — used to create and secure your account.
• Age confirmation — during account setup, you confirm you are 13 or older. Users under 13 are not permitted to create an account. We do not collect a date of birth.

Content You Create

• Photos of artwork — images you capture or upload of your artwork within the App. Photos are used solely to generate animations and are not used for any other purpose.

Automatically Collected Information

• Device information — device platform (iOS/Android), operating system version, screen dimensions, and whether the device is a phone or tablet.
• Usage analytics — which screens you visit, actions you take (such as creating a clip, approving an animation, or rating an animation), and session identifiers. Analytics are stored in our own database and are not shared with third-party analytics providers.

Information We Do NOT Collect

• Real name, phone number, or physical address
• Precise location or GPS data
• Contacts, calendar, or other device data
• Photos from your camera roll (only photos you explicitly capture or select within the App)

2. How We Use Your Information

• Create animations — your artwork photos and animation descriptions are sent to AI services to generate animated videos.
• Save your creations — your artwork, animations, and narrations are stored so you can view and share them later.
• Secure your account — your email and password are used for authentication.
• Improve the App — usage analytics help us understand which features are used and fix problems.
• Safety — the App uses a two-stage person detection system: (1) on-device face detection screens photos for faces before any upload — photos with detected faces are immediately rejected and never leave the device; (2) photos that pass face detection may have a secondary check to detect real human bodies (not drawings or illustrations). Both stages are best-effort safeguards — if either is unavailable, photos may proceed without that screening step. Photos are also screened for inappropriate content before animation.
• Age verification — we confirm account holders are 13 or older during signup.

3. AI-Generated Content

Art Magic uses artificial intelligence to animate your artwork into short videos. All animated videos in the App are AI-generated content.

We use FAL.AI as our AI processing provider. FAL.AI receives artwork photos and animation prompts to generate animated videos. FAL.AI processes artwork only to generate your animation and deletes the artwork image shortly after generating the animation.

We apply safety filters and negative prompts in an effort to prevent the AI from generating violent, scary, or inappropriate content. Parental review is still recommended for every generated animation.

4. Third-Party Services

The App uses third-party services for AI processing, account authentication, and data storage. These services receive only the data necessary to perform their function and are contractually prohibited from using your data for other purposes. Data is stored in the United States.

We do not sell, rent, or trade your personal information to any third party. The App contains no ads.

5. Children's Privacy (COPPA Compliance)

Age Gate

Art Magic is intended for parents and guardians. During account creation, users must confirm they are 13 or older. Users under 13 are not permitted to create an account. This age gate serves as a safeguard to prevent children from signing up independently.

We collect only the minimum data necessary for the App to function: email (for login), artwork photos, and animation prompts. We do not condition participation on providing more personal information than is reasonably necessary.

6. Data Retention

• Account data, artwork, and animations are kept for as long as the account is active.
• Inactive accounts (no login for 2 years) may be scheduled for deletion. We will attempt to notify the account email before deletion.
• When an account is deleted (by user request or inactivity), all associated data is permanently removed: account information, artwork photos, generated videos, narration audio, and analytics events.
• FAL.AI retains artwork for a 24-hour period after processing, then deletes it.

7. Data Security

We implement reasonable security measures to protect your information:

• All data is transmitted over HTTPS (encrypted in transit).
• Passwords are handled by Firebase Authentication and are never stored in plain text.
• AI processing is performed through authenticated, server-side API calls. API keys are stored as server secrets and never exposed to the mobile app.
• Firestore security rules restrict data access to authenticated users viewing only their own data.

No method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

8. Your Rights

All users have the right to:

• Access — View all personal data we hold about you.
• Export — Download a copy of your data.
• Correct — Request correction of inaccurate data.
• Delete — Delete your account and all associated data at any time.

You can exercise these rights directly in the App (Settings > Parental Controls) or by emailing contact@magicsmokestudio.com.

California Residents (CCPA)

California residents have additional rights under the California Consumer Privacy Act, including the right to know what personal information is collected, the right to delete it, and the right to opt out of the sale of personal information. We do not sell personal information.

European Residents (GDPR)

If you are located in the European Economic Area, you have additional rights including the right to data portability, the right to restrict processing, and the right to lodge a complaint with a supervisory authority. Our legal basis for processing is consent (provided during account creation) and legitimate interest (for app functionality and security).

9. Changes to This Policy

We may update this privacy policy from time to time. When we make changes, we will update the "Last Updated" date at the top and increment the version number. For material changes, we will notify users within the App. Continued use of the App after changes constitutes acceptance of the updated policy.
